armed. protesters will rally outside of the alameda county district attorney's office today asking prosecutors to charge an oakland police officer with murder. the officer shot and killed 18-year-old allen blueford during a confrontation in may last year. they say it was justified because blueford pointed a gun at an officer during a foot chase. we'll get a look at what guns the santa clara county sheriff's office collected over the weekend. a show and tell with 1,100 guns turned into saturday at the fairgrounds. the county set aside $150,000 to pay for handguns, shotguns, assault rifles brought in. the bay bridge will shine bright. 25,000 l.e.d. bulbs strewn

across the western span as part of a massive art sculpture. "today in the bay's" bob redell is live by the embark ycadero w a sneak peek. the preview is gorgeous. >> reporter: this is very cool. good morning to you. basically we're on the north side of the western span of the bay bridge. just as we go live is when we peter out the lights. if you want to go to some video you can see what we've shot earlier. in the next 16 hours the city will flip the switch on what is being built as the largest l.e.d. light sculpture. for the next two years the art project will illuminate the northern side of the western span of the bay bridge. every night from dusk until 2:00 in the morning. we're talking about 25,000

individually programmable l.e.d. lights that have been strung up and down the bridge's suspension cables and they will put on a show that will mesmerize the audience and that is anyone in sf or marin with a view of the bay bridge. >> interested in sequences that will display patterns based on all of the motion that i find around the bridge. >> reporter: now, this won't be visible if you are driving into sf via the western span. caltrans insisted lights face out so as not to distract people behind the wheel. the project was created by an artist with roots in silicon valley and now based in new york city. he created this art project using $8 million in private money to give you a sense of how advanced our technology has become, all 25,000 of those l.e.d. lights can be turned on and programmed with just a laptop computer and software.

that boat is expected to arrive any minute now. christie, you were on the story all day yesterday. a wild scene all of the way around. >> reporter: good morning to you, jon. the next chapter in a very unusual story for this luxury yacht "the darling," reported stolen out of the area. three people on board eventually arrested after a standoff with the coast guard and other law enforcement agencies. this is the next chapter. it's being towed here to richmond and here with me this morning is tim parker. good morning. you are with parker diving services. tell us how did you get this boat out? >> what we did is we rigged a bridle on the boat and brought in a tow and hooked them up and did a gentle pull on it, took about four hours of pulling and

it gently came off. we were actually expecting it to take longer to get it off. we weren't expecting it to come off until around 3:00 and it came off at 12:54. >> the three people on this boat, they were just rocking it back and forth, back and forth trying to get it out of the sand. one thing we heard was the keel was stuck. how does that look and is there damage to the boat? >> we don't know. nobody was going to try to dive it when it was pounding around in the surf. we'll find out when they hoist it out here at the shipyard how badly the keel might be damaged. we do know the rutter is spent and i suspect the propeller is spent and the shaft as well. there probably has to be some damage to the hull itself on it but that will be determined when it is hauled out. >> the next 35 minutes or so. >> reporter: thank you for talking with us this morning. we'll stay with us. we are expecting to see the

luxury yacht come in here towed within the next 30 to 40 minutes or so. christie smith, "today in the bay." >> thank you very much. >> there are some calm conditions out on the water as of now but things are going to change in the weather center. hi, rob. >> you bring up a great point. right now the wind is not too strong. no rain to worry about mainly for this morning into the afternoon. later this evening we'll see changes. right now 30s and 40s outside. the only thing that may slow you down weatherwise this morning is patchy fog around the north bay. n winds not too bad. onshore breeze will keep temperatures running cool like we saw yesterday. you'll also notice increasing clouds this afternoon as this cold front drops in from north to south starting off in the north bay. notice the timing. holding off a little bit later. partly cloudy skies through midday and rain through the north bay over the bay bridge as they show off lights tonight. it will be breezy with rain at

times and eventually reaching the south bay after 10:00 tonight. temperatures today upper 50s and low 60s. clouds increasing. winds picking up out of the south. after sundown tonight i think you'll find the rain sweeping on in with scattered showers. maybe a chance of a thundershower into thursday and then we warm up and clear out big-time for the weekend. 60s and 70s coming back early next week. mike? >> we're looking over here toward the bay bridge where right now things are moving smoothly. now, jon and bob and you have been talking about lights on the bay bridge. when that show goes on tonight, viewers on the bay bridge will see the same view. it's facing out so you should not see a disturbance to the flow of traffic. keep in mind some folks may slow down because they're trying to see something. you cannot when you drive across the bridge. we'll look here toward the maps and see flow toward the bridge itse itself smooth off the maze. construction zone going on registered for 880 but slowing both directions looks like it has calmed down. maybe the heavier equipment has cleared from the area. it's still on our reports here.

also west 92 toward the commute direction and toll plaza, that onramp is closed but it's not affecting flow of traffic off 880. commute direction looking smooth here. eastbound countercommute we have register of that road crew there. we don't see slowing. we'll send it back to you with a quick look at the south bay. i'll give you a better look coming up. here's a story in your wheel house. we all know that commuting in the bay area may be a hassle but the question remains does it qualify as a megacommute? that's what the census bureau is now calling a new demographic of people who travel more than 50 miles or spend at least 90 minutes heading one way to work. that's a long time. about 4% of the bay area workforce are considered megacommuters. for the record, if you're curious, the national average is 1%. an italian sailing team is taking up residence in alameda to prepare for this summer's america cup sailing race.

welcome back. look at the bay bridge like you really never have seen it before. >> i like this a lot. >> 25,000 l.e.d. bulbs dancing around. >> bob redell called it gorgeous. i agree. >> i second that emotion. it officially takes effect tonight at 9:00. it is 5:14 now. the fcc is joining the white house this morning in supporting a push to make it legal for you to unlock your cell phone. scott mcgrew joins us. does the fcc have a say in this? >> it often voices opinions in issues it would like to have more influence. in the case of whether a cell phone can be unlocked, that's up to bureaucrats at the library of congress. these are the same people who decide how much money radio stations pay to play songs. now, the unlocking issue only affects a few people.

it's whether you can sign up for at&t and cancel the contract and take at&t's cell phone over to t-mobile. under current law you do need at&t's permission to unlock it to be used on t-mobile thinking they paid for subsidy on that phone so they should have some say as to how it's used. they used to be legal. the rules changed in january. the big takeaway on this really is not whether the cell phone can be unlocked. a fellow from san francisco was able get the federal government to rethink rules simply by asking nicely on that white house petition. shares in apple fell on monday. apple dropped to be the second most valuable company in america once again. let's look ahead at today's market with bertha coombs live at cnbc world headquarters. good morning, bertha. >> good morning. the big thing folks are watching is the dow. we've got futures just higher this morning. the dow continuing that march

toward an all-time closing high. the index now just 36 points away from that mark set back in october of 2007. dow making the move despite not having back-to-back winning sessions in more than a month. stocks yesterday reversed early losses to end in positive territory. for the s&p 500 that's the first winning monday of the year. today we'll get data on the health of services. those are all those nonmanufacturing jobs that most of us work in. the dow rising 38 points monday to its second highest close ever. 14,127. you want to keep your eye on 14,164 today. the nasdaq added 12 to 3182. and, scott, we are coming up on the 13th anniversary of the nasdaq's all-time high close of 5,048. let's not talk about that. >> that's not going to happen. all right. bertha coombs, thank you much. facebook is denying reports that people will need to pay to get

their posts noticed. paying for facebook is a rumor that pops up from time to time but gained traction with someone noticed he has a lot of followers but no readers. the numbers that say lots of people want to see his posts but few people do see his posts. he blogged about it. facebook responded saying it was just sort of the vagueries of the system. facebook meets with reporters on thursday and i'm sure this issue is going to come up. >> i don't want to pay money for that. >> you won't. it comes up all the time. facebook is free. we'll double-check with mark. >> great. thank you, scott. >> facebook is looking for ways to make money. scott will stay on top of that for us. rob mayeda is back to talk about what's happening outside. the rain is approaching. >> rain will come back in. good news for the morning commute. not much happening right now other than patchy fog in the north bay but it is chilly this morning. 34 degrees in napa. 39 in santa rosa.

it is napa. coolest spot we're seeing now where we have fog and not much wind around the north bay now but by sundown tonight we'll see winds picking up out of the south with a cold front on the approach. that's going to bring us rain starting off maybe earlier in the afternoon in the north bay and then moving south later in the evening. winds at times up to 30 miles an hour. gusty at times this evening and then as the main cold front goes through, more showers to follow and lowering snow levels to finish off the week. today we'll see increasing clouds, rain dropping out of the north bay into the evening. first part of the commute is dry and toward midnight you can see rain crossing through the south bay. a dry start to 2013 so far so this system if it can drop at least a half inch of rain in parts of the bay area could easily be the wettest storm we have seen so far and maybe the snowiest in a while for the sierra. looking at more than a foot of snow coming down above 5,000 feet. that's good news in the sierra out of the storm. winter storm warning up for the sierra. cold front out here offshore

behind it colder air aloft will swing through so we'll see sunny breaks. showers at times into thursday. and a chance at seeing snow at times around mt. hamilton as we wrap up the week. close to 60 in san jose. upper 50s back toward the inner bay. low 60s around the tri-valley. 58 in san francisco. clouds fill in today. temperatures cooling off. unsettled weather. chance of thundershowers at times. wednesday afternoon into thursday afternoon friday is the transition day. the showers shut down. a nice weekend ahead. we'll warm up and dry out. 60s and 70s by the time we approach monday of next week. >> all right. we'll look over toward the roadways right now. we're looking at westbound 580. commute direction just fine through livermore but look at this. all of the folks coming in off the altamont pass approaching greenville. that's a typical commute time right now 5:19 just before 5:30 because it's traffic tuesday. heavier volume expected but so far the dublin interchange and also south 680 through pleasanton and sunol looking

fine and clear. we'll watch as we get earlier and heavier build for tuesday. south bay not showing real slowing. north 101 passing by tully there is construction taking down two lanes. they should clear in time for the morning commute. northbound commute direction. i haven't seen any additional slowing there. southbound 880 a few blips and there is construction. road crews down there and that may be slowing down toward the interchange. we'll keep our eyes on that. traveling north through palo alto along the peninsula is an easy drive. light flow of traffic. a few more cars and freeze from digital camera here but we're looking all right past university avenue up into or out of san francisco. 101 and 280 clear on the peninsula. 880 through oakland we pick up more cars. there you go. high street high rise northbound with taillights. southbound with headlights and in the middle they have the construction crew. the roadway itself 880 nimitz freeway that should be cleared now as you head up through downtown through the bay bridge. no backup at the toll plaza and

these folks heading down for east shore freeway at the limit for westbound 80. back to you. 5:20 now. investigative unit exclusive. the state agency paid to protect us from polluters is under fire again today. the investigative unit has learned some leaders at the department of toxic substances control own stock in the same companies they're supposed to regulate. now state senators want their own investigation. the investigative unit obtained financial statements showing two deputy directors have stock in companies including ge, chevron and procter & gamble and companies that dtsc regulates. >> any time you have regulators who have a direct financial interest in the industry, the company or the activity that they are regulating, then that is a conflict of interest. >> investigative reporter vicky nguyen is back tonight with financial statements and a call from several state senators

it's 5:24. scientists at ucsf have discovered a new type of cell that can be used to heal damaged organs. researchers discovered the cells in women's breast tissues. the cells behaved similarly to embryonic stem cells if that they can be programmed to produce many different cell types. scientists say the research is encouraging because it could one day allow for regenerative treatments. a southern california man in jail this morning after allegedly robbing a girl scout cookie stand. collin sawyer walked into a stater brothers on sunday and went shopping and then as he was leaving he allegedly ripped off more than $400 from a girl scout troop selling their cookies outside of the store. so wrong. deputies releasing this video and sawyer was caught late last

good morning. thank you for joining us. i'm jon kelley. >> good morning. i'm marla tellez in for laura garcia-cannon. we begin with a follow-up on a story we brought you yesterday morning. overnight the coast guard pulled a stolen yacht out of shallow waters in pacifica and right now it has landed in the east bay. "today in the bay's" christie smith joins us live in richmond where the boat has just arrived. good morning, christie. >> reporter: good morning to you, marla and jon. just literally arrived. we were sitting in our truck and we looked up and there it was right behind us. that's the "darling" yacht. 82-foot luxury yacht. behind it is a tug boat. we've been waiting for hours. we spoke with the gentleman who helped get it unstuck from where it was in pacifica yesterday. he said that it took several hours. the keel of the boat was several feet down stuck in the sand. he says he was able to do it and

it was just a little bit easier than he thought. here it is this morning. now, of course this is the last chapter in very unusual ordeal. the boat -- there was a distress call yesterday morning around 5:30 in pacifica. the yacht was stuck about 20 yards from shore. now, the coast guard went out to help but three people onboard did not want help. it turns out the yacht had been stolen the night before. there was back and forth. standoff with the coast guard and other law enforcement. finally the three people onboard gave up. they were arrested and then the question was how do you get this thing out of the sand? we spoke with the gentleman responsible for that and here's what he had to say. >> we rigged a big bridle on the boat and brought in a couple vessels and a big long tow and hooked them up and did a gentle

pull on it. took about four hours of pulling and it gently came off. >> reporter: now, the owner of the yacht was actually there on the scene but didn't want to speak with the media and there were reports that he or his wife saw it run aground on television and that's how they knew it was missing from their slip. the cost of something would be about $2.5 million. i asked him there if there were any damage, he said he thought maybe to the keel but he said they won't know until they lift it up which appears to be what they're doing now and the next stop for it is a shipyard for repair. "darling" is not stuck in pacifica any longer. it's in richmond this morning. reporting live in richmond, christie smith, "today in the bay." >> that's one expensive joyride. thank you very much. the san francisco board of

supervisors expects to approve nearly $800,000 in safety improvements for an area of sloat boulevard where a teenager was hit and killed by an alleged drunk driver. there is a crosswalk but no stoplight or stop sign for vehicles. the city now planning a pedestrian safety upgrade in that area. as for the suspect in the crash, 29-year-old brewer remains in jail on felony charges of dui and vehicular homicide. a memorial is growing for the 18 year old gunned down in campbell over the weekend. campbell police say richard vega was walking just north of the campbell community center sunday night when someone came up and shot him multiple times. he was rushed to the hospital for emergency surgery but did not survive. >> from what we know it could have just been mistaken identity

and mistaking him for something else because he wasn't -- he wasn't into anything negative. >> vega was a santa clara high school graduate. 150 former classmates gathered at the school's football field last night to remember and reflect. campbell police say a dark colored car was seen leaving the area after the shooting. if you know anything, you're asked to call campbell police. the san jose city council will meet tonight to discuss a plan to fix the city's deteriorating roads all at a big expense to taxpayers. city officials are proposing new tax measures to pay for road repairs and maintenance. one solution is either a quarter cent or half cent sales tax increase. another is a bond measure that would cost homeowners about $100 a year. time to check in with scott mcgrew and that stock market we can tell you is on fire this morning.

both the s&p and dow within reach of all-time highs right now. that begs the question, what is wrong with apple? >> well, one wonders. its stock price is down so low shares in apple closed down around $420 a share on monday. that's 40% off the company's all-time high. as you point out when you look at market capitalization, total value of shares out there, apple has once again fallen behind exxon mobil in value. shares open at $420.05 on monday. there's growing pressure on ceo tim cook to do something. warren buffett, one of the richest men in the world and astute investor says apple should buy back shares.

in a stock buyback, a company purchases shares from investors which for apple would be cheap. shares then cease to exist. the company doesn't benefit financially. it doesn't keep the shares but the fact that there are fewer shares out there mean people who do own the shares, the apple investors, will benefit because of the law of supply and demand. if apple were to announce a share buyback, jon, today would be a good day. >> absolutely. very interesting story. thank you very much for the update. i'm sure you'll be on top of that one as it rolls on. >> we're rolling on with meteorologist rob mayeda in for christina loren. talking about 30s and 40s. >> you can see temperatures around the bay area right now. 34 in napa. 46 in san jose. and those numbers closer to concord at 40 degrees. partly cloudy skies this morning. and we're going to see the temperatures in the 30s and 40s this morning but no worries about any rain just yet. just patchy fog. you see some of that in napa now. visibility has improved within the last 15 minutes up to just over a mile. not much wind this morning.

that will change later this afternoon as the cold front approaching crescent city sweeps to the south. this is going to increase the clouds and increase the wind and eventually the rain will follow as we head into the evening. so for the most part the day looking at clouds and then eventually toward evening you see rain spreading out of the north bay and heading into san jose as we head toward 9:00 and 10:00 tonight. temperatures in the upper 50s to low 60s but trending cooler the rest of the week. look at the seven-day forecast. you want the umbrella on standby through friday. sunny breaks in between cold showers and chance of thunder at times next couple of afternoons and then you'll see as we head toward the weekend we clear out and warm up. mike? >> standing by with the umbrella. we're looking toward the san mateo bridge standing by at the toll plaza. not a lot of waiting. that's good news. smooth flow over the bridge on the east bay side. a couple things to note for 880 itself. on the maps you look at the 880 flow of traffic. it's smooth but we do have reports of a disabled vehicle. no lane information. my guess is it might be sticking

if washington the slow roll out of the latest budget cuts not the only thing on lawmakers' minds. tracie potts live now with what they're doing to try to prevent a shutdown later this month. we're trying to remain optimistic. do you have good news for us? >> republicans are floating a new budget that doesn't raise taxes and gives defense and veterans affairs more money but for the most part keep spending at last year's level. we'll see how that goes over in the democratically controlled senate. when it comes to cuts already in place, airports starting to feel the pinch because tsa and customs have cut out overtime. that means fewer people to deal with passengers and longer lines in some large airports, the administration saying and passengers have backed that up and here on capitol hill, lawmakers need to cut their own office budgets by over 8% which is actually more than the

full-time employee at moffett field's 129th rescue wing. he's facing two felonies, grand theft and possession of stolen property. the nbc bay area investigative unit first broke this story last night. >> what was his motive? why? >> he didn't readily say that or provide that information other than admitting that he took them without permission. he didn't really explain the motive. he worked there. so he did ve permission to be on the grounds and work there as a military employee. >> once engle learned he was under investigation, he tried to return the rounds. in a statement the california guard said all of the missing ammunition has been recovered and stressed no weapons ever went missing. we have attempted to contact technical sergeant engle. so far no response. in san francisco, police say they have retrieved an assault rifle that looks like this one stolen from one of the department's own vehicles. someone broke into an unmarked

several analysts calling for google to cross 1,000 at some point in the future. a price target. google stock up 15% over the last three months. google opens this morning at $821.50 and then add to that google has 42 billion in cash. we often pick on apple for sitting on money. google could put money to use and that would boost its value. 42 billion is a staggering sum. keep in mind it only took 12 billion to buy motorola. the other thing to watch is the dow. we could set a record for the highest close ever this afternoon. the dow where it was right now in 2007. your magic number 14,164 would set a record close. the highest the dow has ever been is 14,198 in the middle of the day in 2007 and i think everything went fine after that.

"today in the bay's" christie smith is live in richmond right now where the boat arrived a few moments ago. christie, we understand they are now lifting that boat from the water. >> reporter: good morning to you, jon. it was stolen. it was taken for a joyride and now that luxury yacht called the "darling" is here in richmond this morning. it arrived about 30 minutes ago with a tug boat by its side. you can see a hoist is lifting it. it seems to be going up and down. what i'm told is that they're going to pull it out of the water and then put it into a yard nearby and it will have inspections and possibly repairs. i spoke with the salvage company this morning and they are telling me it
